3. Services

3.1 Engagement Agreement

All formal advisory and brokerage services rendered by Business Advisors of America are governed by a separate written engagement or representation agreement signed by both parties. These Terms apply in addition to, and do not supersede, any such signed agreement.

3.2 Sell My Business Services

Our "Sell My Business" service operates on a success-based commission model. No upfront fees are charged for brokerage representation. Commission rates, deal structures, and exclusivity terms will be outlined in your signed Listing Agreement. We act as your representative and advocate throughout the transaction, but we cannot guarantee a sale, a specific sale price, or a specific closing timeline.

3.3 Scale My Business Services

Our "Scale My Business" service is offered on a flat-fee basis. Scope of work, deliverables, timelines, and payment terms are defined in a separate Service Agreement. Results from marketing, SEO, AI implementation, and advisory work vary based on market conditions, industry, business fundamentals, and other factors outside our control. No specific financial outcome is guaranteed.

3.4 Business Valuations

Valuations provided by Business Advisors of America are estimates based on financial data, industry benchmarks, and comparable market transactions. They are opinions of value and do not constitute a certified appraisal. Actual sale prices may differ significantly from estimated valuations.

4. Confidentiality

We understand that the decision to sell or restructure a business is sensitive. Any information you share with us in the course of an engagement will be treated as strictly confidential and will not be disclosed to any third party without your prior written consent, except as required by law or as necessary to facilitate the transaction on your behalf (e.g., sharing information with qualified, vetted buyers under a signed Non-Disclosure Agreement).

By engaging our services, you also agree to keep confidential any proprietary methodologies, pricing structures, buyer networks, or internal processes shared with you by Business Advisors of America.

5. No Guarantee of Results

All case studies, testimonials, client outcomes, and revenue figures referenced on this Site reflect the experiences of individual clients and are not representative of typical results.
